From Ireland to Hungary: Transgender Rights are Treated as a Goal rather than a Requirement

Abstract

This article seeks to evaluate the variation of the protection of trans rights within the European Union. This is done by evaluating the position of trans individuals in the Irish and Hungarian jurisdictions. This research highlights that trans individuals are afforded differing levels of protection dependent on the member state in which they reside. I contend that these inequalities that prevail across the Union are due to the subsidiarity approach the EU has taken thus far. I argue that a pan-european approach would offer greater protection and would ensure consistent treatment across member states.
